The short version
These Terms govern your use of the MLD Services website and the information on it. The Site (including any estimators, calculators, and AI-assisted content) is provided for general information only — estimates and quotes are not binding until put in a signed agreement, and nothing here is professional advice. The Site is provided "as is," our liability is limited, you agree to indemnify us, and most disputes are resolved by binding arbitration with a class-action waiver (you can opt out within 30 days). Texas law governs. Please read the full terms below.
1. Acceptance of these terms
These Terms & Conditions (the "Terms") are a binding agreement between you and MLD Services LLC, doing business as MLD Services (Mechanical, Logistics, and Design) ("MLD Services," "we," "us," or "our"), governing your access to and use of our website at https://mldhvac.com (the "Site") and the content and tools on it. By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site. California residents can review their privacy rights — including how to opt out of any "sale" or "sharing" of personal information — in the Your Privacy Choices section of our Privacy Policy.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site. By using the Site you represent that you meet these requirements and that the information you provide is accurate and current.
3. Our services
MLD Services provides residential and light-commercial HVAC services — including air conditioning, heating, heat pumps, ductless/mini-split systems, and indoor air quality — in Leander and surrounding Central Texas communities. The Site lets you learn about our Services and request contact, estimates, scheduling, financing information, and employment. Use of the Site does not create a service contract; HVAC work is governed by a separate written service agreement and applicable warranty terms.
4. AI-assisted content and automated tools
Portions of this Site may be created or enhanced with the help of artificial-intelligence tools, and the Site may offer interactive features such as cost estimators, calculators, or recommendation tools (collectively, "Automated Tools"). You acknowledge and agree that:
- AI-assisted content and Automated Tools are provided for general, illustrative purposes only and may contain errors, omissions, or outputs that do not reflect your specific situation;
- Any figures, ranges, savings, sizing, or recommendations they produce are estimates only, are not guarantees, and are not a substitute for an on-site evaluation by a licensed MLD Services technician;
- We apply human oversight to material site content, but we do not warrant that all AI-assisted content or tool output is accurate, complete, or current; and
- You should not rely solely on Automated Tools to make purchase or safety decisions.
5. Estimates and quotes are non-binding
Any pricing, estimate, quote, or proposal presented on the Site or generated by an Automated Tool is preliminary and non-binding. Actual pricing and scope depend on an in-person assessment and are binding only when set forth in a written agreement signed by both you and MLD Services. We may correct errors and update pricing at any time before a signed agreement is in place.
6. No professional advice
Information on the Site is provided for general informational purposes and does not constitute professional, engineering, legal, financial, or safety advice. For guidance specific to your property, contact MLD Services and arrange a professional evaluation.
7. Intellectual property and limited license
The Site and its content — including text, graphics, logos, the "MLD Services" and "Cooler Than The Rest" branding, images, and design — are owned by or licensed to MLD Services LLC and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, scrape, or create derivative works from the Site without our prior written permission.
8. Acceptable use
You agree not to:
- Use the Site for any unlawful, fraudulent, or harmful purpose;
- Submit false, misleading, or another person's information without authorization;
- Interfere with or disrupt the Site, attempt to gain unauthorized access, or circumvent security features (including reCAPTCHA);
- Use bots, scrapers, or automated means to harvest data or content from the Site;
- Upload malware or transmit unsolicited or harassing communications.
9. User submissions
If you submit information, reviews, photos, or other content to us, you represent that you have the right to do so, and you grant MLD Services a non-exclusive, royalty-free, worldwide license to use that content to operate and promote our business (for example, publishing a testimonial), unless we agree otherwise in writing. Do not submit confidential information you do not want us to use. We may remove any submission at our discretion.
10. Third-party services and links
The Site may integrate or link to third-party services (for example, financing partners, manufacturers, payment processors, mapping, and review platforms). We do not control and are not responsible for third-party services, and your use of them is governed by their terms and privacy policies.
11. Disclaimer of warranties
The Site and all content and Automated Tools are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, MLD Services disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Site will be uninterrupted, secure, error-free, or that content or tool output will be accurate or reliable. This Site disclaimer does not limit any separate written workmanship or equipment warranty provided in a signed service agreement.
12. Limitation of liability
To the fullest extent permitted by law, MLD Services LLC, its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Site, its content, or Automated Tools, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site and these Terms will not exceed one hundred U.S. dollars (US $100.00). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case, our liability is limited to the greatest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless MLD Services LLC, doing business as MLD Services, and its owners, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any law or third-party right, or any content you submit.
14. Pricing, billing, and financing
Payment for HVAC services is governed by your signed service agreement and invoice, not by the Site. MLD Services offers financing through independent third-party lenders; approval, rates, and terms are determined solely by the lender and are subject to the lender's application, terms, and privacy policy. 15. Governing law and venue
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, you agree that the exclusive venue for any permitted court action will be the state or federal courts located in Williamson County, Texas, and you consent to personal jurisdiction there. 16. Binding arbitration and class-action waiver
Please read this section carefully — it affects your legal rights. Except for (a) claims that may be brought in small-claims court and (b) claims for injunctive relief to protect intellectual property, you and MLD Services agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by final and binding individual arbitration, administered by a recognized arbitration provider under its consumer rules, rather than in court. The arbitrator decides all issues, except that a court may decide the enforceability of this section.
Class-action waiver. You and MLD Services agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
30-day opt-out. You may opt out of this arbitration and class-waiver provision by sending written notice to [email protected] or the mailing address below within 30 days of first accepting these Terms, stating your name and intent to opt out. Opting out does not affect the other provisions of these Terms. This section survives termination of your use of the Site.
17. Informal dispute resolution
Before starting arbitration or any permitted court action, you agree to first contact us at [email protected] or 512-528-4258 and give us 30 days to resolve the matter informally and in good faith. Many issues can be resolved quickly this way.
18. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination (including Sections 7 and 11–17) will survive.
19. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force and effect.
20. Entire agreement; assignment; waiver
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MLD Services regarding the Site and supersede any prior agreements on that subject. We may assign these Terms; you may not assign them without our consent. Our failure to enforce any provision is not a waiver of it. (Signed service agreements govern the HVAC services themselves and control over these Terms to the extent of any conflict regarding that work.)
21. Changes to these terms
We may update these Terms from time to time. We will revise the "Last updated" date above, and your continued use of the Site after changes become effective constitutes acceptance of the updated Terms.
